CYTOCHROMA MOVES
FORWARD DESPITE GENZYME LAWSUIT
August 22, 2006 – Cytochroma
Inc. of Markham, Ontario, Canada Canada today issued
the following statement in response to a lawsuit filed against
company executives August 8, 2006 by Genzyme Corporation
of Massachusetts that alleges improper use of intellectual
property and related matters:
“The Genzyme lawsuit is without merit
and Cytochroma will vigorously defend its position. We are
confident that Cytochroma
will prevail if this matter ever goes to court.
“Cytochroma and Genzyme are competitors in a large
and growing industry, but in no way was Genzyme’s patented
or proprietary information, expertise or intellectual property
used to further
Cytochroma. For Genzyme to suggest otherwise and file this
lawsuit, curiously, as Cytochroma is in the midst of pursuing
investors, is wrong.
“We believe the facts will show that our managers who are the target of
this lawsuit scrupulously complied with their non-compete agreements and acted
with integrity. The facts will further indicate that the Vitamin D product portfolio
and components that are involved in this matter are not owned by Genzyme but
currently rest in the public domain.
“When all the facts are laid out we are confident that the matter will
be resolved
in favor of Cytochroma and its employees.”
